Release of Liability

This form is for guests participating in our Dolphin and You program. Please read the following carefully, and sign.

 

I, _______________ am participating in the Dolphin and You program on my own will.

 

1. I hereby declare to be of sound mind and body. I understand that this tour includes but is not limited to: swimming, snorkeling, physical excersise, kayak paddling, hiking along the coast which may be physically demanding. I also understand that this program is subject to interaction with wild animals, and changes in program due to weather, or any other "Acts of God" and this program is not meant to treat any medical conditions.

 

2. I fully understand the laws that prohibit the harm of any sea-going mammal and promise to abide by these laws. I accept the responsibility of respecting these laws, and promise not to harm any dolphins, coral, or their environment.

 

3. I understand that the conductors of the Dolphin and You programs may cancel for any reason. Upon cancellation of the tour, I will accept refund for any unused portion of the cancelled tour. However, if I for any reason, should cancel the tour, there will be no refund, and any balance remaining shall be paid in a swift and prompt manner.

 

4. All materials used during the Dolphin and You program remains the property of Dolphin and You, and cannot be used without written permission. I also promise that any material shall not be printed or used for purposes outside of said program.

 

5. I promise that Dolphin and You, it's staff, owner(s), sales representative shall not be held responsible for any loss of personal material or life,and / or injuries under any circumstances.

 

6. I, my family, or any representative there of, shall agree to the conditions of this waiver. I also understand that this agreement is binding in part or whole, and is in compliance with the laws and regulations of the State of Hawaii.

 

7. I understand that all DVDs and photographs taken during the Dolphin and You program may be used for the promotion of Dolphin and You by it's representatives and advertising agencies. I am legally an adult, and my signature binds me by the rules and regulations. Parents or guradians shall sign for minors under the legal adult age. I understand that the preceding is a legal document and sign on my own free will.
